The client agrees to cooperate in a timely manner and provide feedback during the design and development process.

3. Payment and Fees

The client agrees to pay the fees as outlined in the project proposal or quotation provided by the Company

Payment is due according to the agreed-upon schedule. Failure to make timely payments may result in project delays or termination.

4. Intellectual Property

The Company retains ownership of all intellectual property rights related to the design and development of the website until full payment is received.

Upon full payment, the client is granted a non-exclusive, non-transferable license to use the website for its intended purpose.

5. Confidentiality

Both parties agree to keep confidential any proprietary or confidential information shared during the course of the project.

The Company may use the client’s project as part of its portfolio unless the client explicitly requests otherwise in writing.

6. Termination

Either party may terminate the agreement with written notice if the other party breaches any material term of these Terms.

In the event of termination, the client is responsible for payment for services rendered up to the termination date.

7. Limitation of Liability

The Company is not liable for any indirect, incidental, or consequential damages arising from using its services.

The Company’s total liability for any claim arising out of or relating to these Terms or the services provided shall not exceed the total fees paid by the client.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of Osceola County, Fl. 

9. Changes to Terms

The Company reserves the right to modify these Terms at any time. Updated Terms will be posted on the Company’s website. By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and any modifications made to them. 1. Return on Investment (ROI) Statement:

The Return on Investment (ROI) statement is contingent upon the effectiveness of the client’s digital marketing and sales efforts, utilizing the website as a tool for lead generation and conversion.

The Company does not guarantee specific results and is not responsible for the client’s overall business success.

2. 15 Business Day Guarantee

The commencement of our 15 Business Day Guarantee is subject to the timely receipt of all necessary information for the design process.

The guarantee covers the initial design and development phase. Any delays caused by the client, including late provision of information, may result in an extension of the delivery timeline.

3. Billing and Taxes:

The total amount will be billed in accordance with the selected plan commitment as outlined in the project proposal or quotation.

All applicable taxes are included in the total amount. The client is responsible for any additional taxes or fees relevant authorities impose.

4. Additional Costs:

Any additional features, services, or changes requested by the client that are outside the scope of the initial project proposal may incur additional costs.

The client will be notified of any additional costs before implementation, and work will only proceed upon the client’s approval.

5. Maintenance and Support:

The Company provides maintenance and support services as outlined in the selected plan. Additional support beyond the agreed terms may be subject to additional fees.

The client is responsible for regularly updating website content and ensuring compatibility with the latest web browsers and technologies.

6. Third-Party Services:

The Company may utilize third-party services or tools in the design and development process. The client agrees to adhere to the terms and conditions of such third-party services.

The Company is not responsible for any issues arising from changes or disruptions in third-party services.

7. Communication:

All communication regarding the project, including feedback and approval, should be provided in a timely manner.

The Company is not responsible for delays caused by the client’s failure to respond promptly to requests for information or feedback.
